Terms and Conditions of Sale

Scope

These general terms and conditions of sale govern all transactions made by Elektroid, an Italian company registered with the Chamber of Commerce under number 01793080084, with its registered office at Via Feraldi 3, San Remo.

Unless expressly and in writing agreed by Elektroid, no other general or special conditions of the customer can prevail over these general terms and conditions of sale.

In accordance with Italian legislation, the Italian Civil Code, in particular the provisions relating to commercial contracts (art. 1321 et seq.), as well as European legislation, in particular Directive 2011/83/EU on consumer rights, govern commercial transactions and the protection of consumer rights.

Elektroid reserves the right to modify these general terms and conditions of sale at any time. The new general terms and conditions of sale will apply to any order placed after their publication on our website.

By placing an order, the customer acknowledges having read these general terms and conditions of sale and accepts them without reservation. The general terms and conditions of sale are available on our website and can be provided upon request in-store.

Intellectual Property

Elektroid recognizes and respects the intellectual property rights of third parties. Trademarks, logos, product names, and other content protected by intellectual property rights belong to their respective owners.

Under Italian law, particularly the Intellectual Property Code (Legge sul Diritto d'Autore) and European directives, Elektroid holds exclusive ownership of all content presented on our website, including product descriptions, summaries, titles, and images.

By using our website or purchasing our products, customers and competitors acknowledge and accept that:

  2. All content present on the Elektroid website, including product descriptions, summaries, and images, is the intellectual property of Elektroid and is protected by law.
  3. Any unauthorized use, reproduction, or distribution of content, as well as content protected by intellectual property rights, is strictly prohibited and may result in legal action.

According to European directives, particularly Directive 2004/48/EC on the respect for intellectual property rights, fines for intellectual property infringement can be significant and vary depending on the severity of the infringement. For example, a recent court decision fined a company for trademark infringement and copyright violation, resulting in a fine of 50,000 euros plus legal costs.

Elektroid reserves the right to take appropriate action in case of alleged infringement of intellectual property rights, including termination of the customer's account or legal action before the competent courts, with the possibility of demanding fines in accordance with Italian and European legislation.

This section aims to inform customers and competitors that any violation of Elektroid's intellectual property may result in significant financial penalties, in addition to legal actions aimed at protecting the company's intellectual property rights.

Products

We offer a range of electronic products for sale, including smartphones, tablets, computers, and accessories, both new and used. We reserve the right to modify our range of products at any time. Product availability may vary and is subject to change without notice.

The descriptions and specifications of products provided on our website or in-store are for guidance only. Elektroid reserves the right to modify these descriptions and specifications at any time without notice. These modifications will not affect orders already accepted, except in cases of absolutely necessary modifications and after prior notification to the customer.

  • Returns

To qualify for a return or refund, the product must be returned in its original packaging and in new condition, complete with all accessories and documents provided at the time of purchase. Return shipping costs may be borne by the customer, except in cases of non-compliance or defective products.

Once the returned product is received and its condition verified, we will proceed with the refund or exchange in accordance with applicable law. We are committed to processing your return request as soon as possible to ensure your complete satisfaction.

Orders

Orders can be placed online via our website or in person at our physical store. Each order is subject to our acceptance, and we reserve the right to refuse an order for legitimate reasons. The order is considered confirmed once payment is accepted and confirmed by our online payment system, or once the product is shipped, as applicable. Once the order is confirmed, it is final and binding.

Prices

The prices indicated for our products are in euros and are displayed on our website and in-store. They are subject to change without notice, but the prices applicable to an order are those in effect at the time of placing the order. Shipping costs, if applicable, are specified during the ordering process.

  • Accepted payment methods are as follows:

Online: credit card and PayPal.

In-store: credit card, check, or cash.

Please note that the prices indicated do not include any applicable taxes, which will be added during the ordering process if necessary. Please note that new and refurbished products may be subject to different taxes. Applicable taxes will be specified at the time of order finalization.

Shipping

Product delivery is made to the address indicated by the customer at the time of ordering. Delivery times are indicative and may vary depending on product availability and the delivery location.

Elektroid undertakes to respect the announced delivery times; however, delays may occur due to circumstances beyond our control such as logistical problems or adverse weather conditions. In such cases, we undertake to inform the customer as soon as possible and to take the necessary measures to resolve the situation as quickly as possible.

Once the order is shipped, a confirmation will be sent by email to the customer. Additionally, the customer can also access their customer account on our website to track the latest updates on their order. In case of loss or damage to the package during transport, the customer must contact us by email at the address contact@elektroid.net. Our customer service will handle the situation and take the necessary measures to resolve the issue as soon as possible.

In accordance with Italian legislation, the Italian Civil Code, in particular the provisions relating to sales contracts (articles 1510 et seq.), as well as European legislation, in particular Directive 2011/83/EU on consumer rights, govern delivery obligations, any delays, and the seller's liability.

Elektroid assumes responsibility for delivering the products until receipt by the customer, in accordance with these laws. Any problem or damage during transport must be reported immediately to our customer service, preferably within 48 hours maximum, so that corrective measures can be taken.

We deliver our products throughout Europe, as well as to regions outside the European Union.

Repairs and Purchases

We offer a wide range of services for electronic products, including repairs, purchases, and resale of used items. For repairs, our services cover a variety of issues, from minor repairs to complex repairs. Specific details about the types of repairs we offer, as well as associated rates and warranties, are available on request and are an integral part of our general terms and conditions of sale.

Regarding purchases, we carefully evaluate each used electronic product to determine its condition and market value. Acceptance criteria for products for purchase may vary depending on various factors such as age, condition, and market demand. We would like to emphasize that we reserve the right to refuse any product that does not meet our quality or safety criteria.

Regarding the resale of used products, we are committed to providing items in good working condition and clearly specifying their condition in our listings. We ensure that our customers know exactly what they are purchasing and benefit from a transparent and satisfactory purchasing experience.

All our repair, purchase, and resale activities comply with Italian and European legislation. In Italy, sales contracts are governed by the Italian Civil Code, especially articles 1469 et seq., which establish the rights and obligations of the parties. Additionally, EU Directive 2011/83/EU on consumer rights provides additional guidance on consumer rights in commercial transactions. We are fully committed to complying with these laws to ensure transparency, reliability, and customer satisfaction.

Warranty

We offer several warranties depending on the type of product you purchase from us:

  • Repairs: Repairs carried out by us are guaranteed for a period of 3 months from the date of repair, covering replaced components or work performed.
  • Refurbished Products: Refurbished products are covered by a one-year warranty from the date of purchase.
  • New Products: New products are covered by a two-year warranty from the date of purchase.

These warranties are provided in accordance with Italian and European legislation. In Italy, the Italian Civil Code, especially articles 1490-1494, governs the legal warranties applicable to goods sold. Additionally, EU Directive 1999/44/EC on consumer rights provides additional guidance on consumer rights regarding consumer goods.

It is important to note that these warranties only cover manufacturing defects and do not apply to damage resulting from improper or abusive use. Damage caused by improper or abusive use of the product will void the warranty. The law specifies that the seller's liability for hidden defects does not apply when the damage results from improper or abusive use of the product, in accordance with article 1495 of the Italian Civil Code.

Right of Withdrawal

In accordance with Italian legislation, the right of withdrawal does not apply to repair services. For other products, the customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to provide justifications or incur penalties. This right is regulated by article 52 of the Italian Consumer Code (Legislative Decree no. 206/2005), in accordance with Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.

The terms of exercising the right of withdrawal include returning the products in their original condition, in their original packaging, and with all relevant accessories. The customer is responsible for the return costs of the products, unless otherwise indicated by us.

Once the returned products are received and their condition verified to be compliant, we will proceed with the refund of the amounts paid by the customer, including any initial shipping costs if applicable, as soon as possible and in any case within 14 days from the receipt of the returned products. The refund will be made using the same means of payment used by the customer for the initial transaction, unless expressly agreed otherwise by the customer.

Disputes

This contract is governed by Italian law. In the event of a dispute, the customer can contact our customer service at the email address contact@elektroid.net. In the event of a dispute not resolved by amicable negotiations, the dispute will be subject to judicial jurisdiction in accordance with Italian law. This jurisdiction is established according to the rules established by the Italian Civil Procedure Code (Legislative Decree no. 186/2020).

Additionally, the customer also has the option to resort to mediation bodies or online dispute resolution platforms, in accordance with Directive 2013/11/EU of the European Parliament and of the Council on alternative dispute resolution for consumer disputes and Regulation (EU) No. 524/2013 on online dispute resolution in consumer matters.
